These general conditions apply to all orders placed on the website https://www.maritounettedessin.fr. By validating his order, the user declares to have read these general conditions of sale and undertakes to respect them.

By these General Conditions of Sale, the user confirms that he is over 18 years old or has obtained the authorization of his legal representative to place an order on the site.

Within the meaning of Article L 110-1 of the Commercial Code, the user is prohibited from any purchase for resale.

These conditions may be subject to change without notice. These are the general conditions of sale applicable at the time of placing the order which are those in force.

Products

The products offered for sale are the products presented on the site on the day of the consultation of the site by the user.

The restitution on the Site of the colors of the products is not contractual, because the colors presented on a computer screen differ according to the configuration of the station and the quality of the image of the screen the restitution on the Site of the textures of paper is not contractual, for the same reasons consequently, the responsibility of the seller could not be engaged because of a marginal nuance between the appearance of the product visualized on the Site, and the product delivered to the User.

Items are provided within the limits of available stocks.

Prices

The prices of the products are indicated in euros including VAT (VAT not applicable, art.293 B of the CGI).

The prices displayed do not include delivery costs, which depend on the delivery method chosen by the user and which are added to the total amount of the order at the time of its final validation to form the overall price.

The site reserves the right to modify its prices at any time, it being understood that the price appearing on the site on the day of the order will be the only one applicable to the user.

Confirmation of the order

It is up to the user to ensure the accuracy of the information provided, for which he is solely responsible. The user will not be able to request a refund for his order in the event of an error or spelling error on his part in the personalization of an article.

The User declares to have read these general conditions of sale before validating the order. Consequently, the validation of the order, during the order summary stage on the site, is worth full and unreserved acceptance of these general conditions of sale.

The seller undertakes to honor each order placed on the site within the limits of available stocks. In case of out of stock, it undertakes to inform the user.

Payment

Payment is due upon validation of the order.

The order can be paid by the following means:

Delivery

The delivery times appearing on the site are only given, unless otherwise stipulated, as an indication. Any delays cannot give the user the right to cancel the order, to refuse it or to claim damages.

Deliveries are made in mainland France and internationally.

Deliveries are made by post or by parcel relay, at the buyer’s choice.

The items will be delivered to the delivery address indicated by the buyer when paying for his order.

In the event of a group purchase of several products, the delivery time applicable to the entire order corresponds to the longest time indicated for one of these products.

The seller declines all responsibility for any delays, thefts, losses or damage to the package by La Poste and parcel relays.

Upon receipt of the order, the user is required to check the condition of the packaging as well as the products ordered.

The user must make the reservations and complaints he deems necessary, or even refuse the package, when the package is obviously damaged. Said reservations and complaints must be addressed to the carrier

Right to retract

Under Article L. 121-20-2 of the Consumer Code, the right of withdrawal cannot be exercised for products concerning goods made to the user’s specifications or clearly personalized. No right of withdrawal can therefore be applied for products with personalization.

The right of withdrawal, however, applies to others. In this case, the user has a period of 14 calendar days from receipt of his order to exercise his right of withdrawal by contacting the seller using the contact form, by e-mail or by post.

Otherwise, the user must return the products no later than 14 calendar days following the communication of his decision to withdraw.

This right can only be exercised if all the copies of the products concerned are returned in their original packaging, the return costs being borne by the user. Any damage suffered by the product on this occasion may be such as to defeat the right of withdrawal. The seller reserves the right to accept or refuse the returned item depending on its quality.

In the event of exercise of the right of withdrawal, and in accordance with the preceding mentions, the seller will reimburse the amount of the order excluding shipping costs.

force majeure

The responsibility of the seller cannot be implemented if the non-execution or the delay in the execution of one of its obligations described in these general conditions of sale results from a case of force majeure. As such, force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.

Intellectual property

All the creations presented on the site are protected by copyright and trademark law.
Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the site, whatever the means or process used, is strictly prohibited without the prior authorization of the seller.
Any other use constitutes counterfeiting and will be penalized under intellectual property.

Personal data

The personal information collected from each user is kept confidential by the seller, who undertakes not to communicate it to a third party.

Information and data concerning users are necessary for the management of orders. In accordance with the provisions of the Law of January 6, 1978 relating to data processing, files and freedoms, modified by the Law of August 6, 2004, users have the right to access and rectify personal data concerning them with of the controller. Jurisdiction

Any dispute relating to the validity, interpretation, acceptance or execution of this contract, which cannot be resolved amicably, will be subject to the jurisdiction of the competent courts located within the jurisdiction of the registered office of the society.
